The following general business conditions of PROPERTY-ADVERT-THAILAND.com (in the following referred to as PROPERTY-ADVERT) regulate the cooperation with the interested parties for real estate who access the pages of PROPERTY-ADVERT in order to obtain information about the offers
PROPERTY-ADVERT retains the right to adjust the AGB at any time. The AGB apply that are publicized on the website. - Access to the PROPERTY-ADVERT database
PROPERTY-ADVERT enables enquirers of real estate free access to PROPERTY-ADVERT objects in its databank over the internet. No claims for the right to access can be made, and PROPERTY-ADVERT can deny any further access or usage. - Contractual relations
No purchase, rental or service contracts for the purchase or rental of the objects featured in advertisements on the websites of PROPERTY-ADVERT can be made through PROPERTY-ADVERT. Purchase, rental or service contracts for the purchase or rental of the objects featured in advertisements on the websites of PROPERTY-ADVERT can only be made between the interested parties and the actual offering parties. - Liability
PROPERTY-ADVERT only shows the information it obtained from the offering parties on the pages of the PROPERTY-ADVERT network, without investigating if the details are correct. Therefore, PROPERTY-ADVERT cannot be held responsible for the correctness of the featured information.
PROPERTY-ADVERT does explicitly not act as the offering party but only provides a platform on which private and commercial offering parties can offer objects to interested parties. - Information from cooperation partners
PROPERTY-ADVERT also provides information on its website about suitable cooperation partners. The relevant cooperation partner is responsible for its content. Only their own conditions apply for their services. - Legal right
The legal relations between PROPERTY-ADVERT and the interested parties are governed by the laws of the Kingdom of Thailand.

1. Generalities, area of validity
The following points talk about the general business conditions for the advertising market offered by Property Advert Thailand (in the following called Property-Advert) for rental, purchase and request advertisements, which are regulated according to the relation of the offering parties of such advertisements.
2. Property-Advert services
In case of offers Property-Advert will provide interested parties online over the internet, based on the given costs of the object calculated exposès.
The selection of suitable inquirers and suitable offers is done by Property-Advert. Property-Advert is always eager to adjust and keep its services up to the latest technological developments and latest market developments. Property-Advert thus retains the rights to make changes to the agreed services, as long as such changes will not affect the core services and done with consideration to the interested parties of the contractual partner.
3. Information from the suppliers [top]
The offering party is obliged to exclusively provide respectable real estate offers and to carefully and truthfully collect the received information about the offer given to Property-Advert and to immediately deactivate these if the offered object is no longer available (e.g. marketed or reserved).
Furthermore, the offering party is also obliged to offer only real estate offers, which are in his own marketing arsenal or for which he has received a marketing order.
The offering party is solely responsible for the contents and correctness of the transferred information. He must specify all properties and characteristics that are important factors of the decision making criteria truthfully. In addition, he is obliged to not transfer any data, of which content violates the rights of a third party (personality rights, name rights, trade mark rights, etc.) or are against the law.
The offering party will keep Property-Advert free from any claims from any third party that were made valid against Property-Advert in regard to such violations. This also includes the reimbursements of costs for necessary legal representatives.
Offers designed to exclusively serve the objective to attract the attention of interested parties are regarded as abusive and will be cancelled by Property-Advert after a single announcement. Such offer designs include, for example:
* False or incorrect information in the object address
* To abuse exposès as advertising platform for the own company
* To attract the attention of searching parties by making incomplete or false statements (e.g. incomplete offers, false address information or geographical date, etc.)
* The transfer of interested parties to charging internet or telephone services
* Objects of which address or contact data is released only after charging a registration fee.
Such data represent a manipulation of our search engine. Many searching parties are being confused or deceived by such practices.
4. Non-transferability and confidentiality [top]
The rights of the offering party from this contract are not transferable.
The password, which enables the offering party to access the personal area and thus also the data collection, must be treated strictly confidential and must not in any case be transferred to any third party. The offering party must take suitable and appropriate measures to prevent any third party from knowing his password.
5. Rights [top]
All rights (copy rights, trade mark rights and other protection rights) for the databank work, the databank and the here set contents, data and other elements are exclusively reserved for Property-Advert. Possible rights of the offering party for the set contents remain unaffected by this.
The offering party has - within the framework of these user conditions - the right, exclusively with usage of the online search masks provided by Property-Advert, to make individual data sets visible on his monitor and to make a permanent printout of the data sets. An automatic search by scripts or similar means is not allowed. Any copy right information or other protection right remarks on the website of Property-Advert must not be altered.
The supplier may do the data won by query neither completely nor partial or in an abridged version
(a) to the construction of a database of one's own in every middle form and/or
(b) for a commercial data utilization or information granting and/or
(c) using another commercial utilization for one.
The Verlinkung, integration or other combination of the database or single elements of the database with other databases or Meta databases is inadmissible.
Furthermore, Property-Advert receives the right to alter the content; especially it doesn’t correspond to the requirements according to Point 3 of this AGB.
6. Usage of the information provided by Property-Advert [top]
The offering party is obliged to use the information about inquiries - given to him in regard to the offer – only in connection with the intended concrete real estate business. Any transfer of information to third parties or usage of the information for any other purpose is not allowed.
7. Sending of additional information and offers, additional offer circulation [top]
Property-Advert is authorized - but not obliged - to transfer also its own and other additional information or additional offers to offering parties and inquiries, which are connected to the proposed sales, purchase or rental deal.
Property-Advert is also authorized - but not obliged – to carry out a free-of-charge additional circulation of the offer for the offering party through cooperating real estate agents.
8. Saving of data [top]
The data that was transferred by the customer to Property-Advert will be saved and processed by Property-Advert for the above-mentioned purposes and for individual purposes arising from customer orders. Property-Advert will observe the applying data protection regulations in its actions.
9. Availability of Property-Advert-Thailand.com [top]
Property-Advert is generally available 24 hours a day. Property-Advert is dependent on the technical facilities of third parties, the operation of which are not within the area of responsibility of Property-Advert. Therefore, Property-Advert will not offer a guaranty for the uninterrupted connection nor for an uninterrupted availability of all services.
10. Payments, contract closing, publication of advertisements [top]
The payment for the private online real estate advertisement is done using the payment system.
For the utilization of the payment system a separate registration at THAIEPAY is necessary through the real estate offer provider. As payment method there is a choice of transfer, credit card and debit note.
Payments cannot be made by sending cash or checks to Property-Advert. Property-Advert will not be responsible for loss.
After the successful payment of the invoice for the online advertisement by the real estate advertisement provider at THAIEPAY the real estate advertisement will be released for publication as exposè in the Property-Advert network.
One day after the expiration date the private online real estate advertisement will be automatically deactivated by Property-Advert and thus it will no longer be published as exposè in the Property-Advert network. A deletion of the private online real estate advertisement during the validity period will also end the publication.
11. Liability [top]
Property-Advert will only be responsible for errors in the description of the online real estate advertisement, for which Property-Advert can be held accountable, e.g. errors in the Property-Advert web application or in the Property-Advert databank.
Property-Advert will not be responsible for errors or mistakes that were caused by a false object data entry and object data administration carried out by the advertiser.
In case there are justified reasons to doubt the correctness of the information or in case there is a danger that the interested parties might be mislead by the information, Property-Advert retains the right to withdraw from the offer. The private real estate offer provider cannot make any claims from such withdrawals.
Property-Advert will not be responsible for the description of objects on the websites from partners of Property-Advert, that don’t belong to Property-Advert.com and are not distributed by Property-Advert.
12. Performance [top]
Liability claims for faults against Property-Advert can only be made for non-performance of the contract.
In case of non-performance the real estate offer provider can withdraw from the contract or can demand a discount of the fee.

The advertisements published by Property-Advert (in the following referred to as PAT) are checked with the utmost care. However, PAT cannot be held responsible for their contents. Only the orderer himself is responsible for the content.
Despite of the careful check of the contents PAT is not responsible for the contents of external links. Only the operator of such links himself is responsible for the content.
In addition, PAT assures that personal customer data will be treated with the utmost care and will not be transferred to any third party without the consent of the customer.
